Washington DC Gun Law Likely Unconstitutional

A Washington D.C. gun law was struck down Tuesday (May 18th 2016) by a district court judge.  He said that they law requiring people to prove that they have “a good reason to fear injury” most likely places an unconstitutional burden on the second amendment.  Enforcement of the law is now delayed and the case is likely to be appealed to a higher court.

The ruling reignited a running battle over the second amendment in the district.  The law required that individuals must have a “good reason” in order to be able to obtain a permit to carry a firearm in the nation’s capital.

In a 46 page opinion the Judge Leon wrote:

The enshrinement of constitutional rights necessarily takes certain policy choices off the table,

He said that the district’s position was understandable but overzealous.

The law matches those in other states (Maryland, NJ and NY) that have been upheld on appeal.  It joins those state in being among the strictest in the nation.
